If you need to file for divorce, or your spouse is filing for divorce, you need an attorney to look out for your interests. Trial isn't the only path forward but sometimes trial is the best path forward. Courts in Minnesota typically require that the parties attempt to settle issues before requesting that a judge weighs in. There are many considerations when it comes to divorce, and this is by no means a comprehensive list below.     ASSETS & DEBTS
    If you don’t have children, or your children are adults, or you don’t have disagreements about what’s best for the children, then your divorce will likely be about property division, and ensuring both spouses have the means to move on - that includes consideration of the debt division. You may have real estate, retirement, stocks and investment accounts to consider.

    NON-MARITAL PROPERTY
    If you owned certain assets prior to the marriage, or you received an inheritance before or during the marriage, inform your attorney right away. The Court requires research and documentation to show that property is non-marital in nature.

    SPOUSAL SUPPORT
    If one of the spouses cannot support themselves after the separation, or needs some college courses or job training before being self-supporting, or, if one of the spouses never worked during the marriage, spousal support may be a consideration.

    CHILD RELATED ISSUES
    If you have children, their best interests come first. Child related issues include custody, parenting time, and child support. You may need to request that the Court issues a temporary order for custody and parenting time while the divorce proceedings are pending. Some parents inappropriately control the children or withhold the children from the other parent. However, there may be good reasons to withhold a parent’s time with the children, particularly if there is physical or mental abuse, or substance abuse is involved. You may need to request temporary child support while the divorce proceedings are pending, or, you may need to respond to the other parent’s temporary requests. If the other parent filed custody paperwork, please get in touch with an attorney TODAY. The Court’s custody order will impact your ability to make decisions for your child(ren).

    If you’re a full time parent who hasn’t left yet because you don’t have the resources to leave, you don’t have to be stuck in a loveless marriage (or worse). Your attorney can ask the Court to grant you temporary spousal support and need-based attorney’s fees while the divorce is pending. You may be able to finance your initial attorney’s fees so that you can get the process started. I have an option available for you, should you qualify.

If the other parent is withholding your child from you, minimizing your time with your child, refusing to give you information about your child’s healthcare or schooling, or refusing to involve you in major decisions that impact your child’s well-being, it’s time to go to court.
